Shell-Modern Hire Privacy Policy

Learn more about our privacy policy, which covers collecting, using, and protecting data submitted to Modern Hire on behalf of the Shell Group for video interviews and assessments during the recruitment process.

What does this privacy policy cover?

The privacy policy is to inform you about the use of your personal data which is submitted by you to Modern Hire, in its capacity as Data Processor and at the direction of Shell Group, as Data Controller, during the video interview recordings, assessments and related interactions (collectively, “Digital Interactions”) and as further collected, used, processed and transferred (collectively, “Processed”) as part of the Shell recruitment process and/or otherwise for potential employment with the Shell Group of companies.

This Privacy Notice explains what personal data we process about you, why we are processing your personal data and for which purposes, how long we hold your personal data for, how to access and update your personal data, as well as the options you have regarding your personal data and where to go for further information.

Who will be responsible for your data?

Shell International B.V., a company registered in The Netherlands with registered number 27155369 whose registered office is at Carel van Bylandtlaan 30, 2596 HR The Hague, The Netherlands is responsible for processing your personal data (Data Controller). References in this privacy policy to “us” or “we” or “our” means Shell or Shell Group of companies.

The Digital Interactions are Processed for the purposes of the recruitment process with the Shell Group of companies and will be hosted by Modern Hire as Data Processor with principal offices situated at 3201 Enterprise Parkway, Ste 460, Cleveland, Ohio 44122 , at the direction of Shell (as Data Controller) on Modern Hire servers located in the EEA, US, or Australia.

What information do we collect?

When participating in a video assessment, we will collect information that you provide by submitting the video interview (your name, likeness, voice, personal information provided during the video assessment, including your professional experience, education details, skills and characteristics as well as personal experience). The information we collect may include sensitive personal data, only to the extent necessary for purposes of conducting the video assessment and/or if mandated by local laws due to diversity regulations.

Purpose of the collection of your data

The purpose of the Digital Interaction is to allow Shell to evaluate your suitability for potential employment in accordance with the description of the position and the requirements of the recruitment process. We collect and use personal information submitted through the video interview as part of the Shell recruitment process. We would therefore use your personal information for:

a) the selection process of Shell companies worldwide and in connection with Shell’s decisions on any potential employment or placement;
b) informing you of future suitable vacancies;
c) activities related to general human resources management and administration, including statistical analysis and the ongoing evaluation of our recruitment programs;
d) surveys regarding the quality of the recruitment process;
e) technical support, anticipating and resolving problems with the video assessment or other parts of the recruitment process as well as improving the service;
f) respond to queries or requests submitted by you with regard to the video assessment and/or the recruitment process; and/or
g) activities related to the improvement of the video assessment process.

Additionally, please note that the entity hosting the solution, Modern Hire, may use the information that you provide in an aggregated form to understand and analyze the usage trends, interests, and preferences of the individuals that have used the video assessment service, to improve the way the video assessment works and looks, and to create new features and functionality. For these purposes, Modern Hire may use “automatically collected” information and “cookies” information to: (a) personalize the video assessment service, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) monitor and analyze the effectiveness of application and evaluation activities; (c) monitor aggregated usage metrics such as total number of users, pages and media and features of the Service video assessment service; and (d) track your entries, submissions, and status, including the ways in which you may interact with the video assessment service.

Please be assured that we will not use your information if you have indicated that you do not wish us to use your information in this way when submitting the information or at a later stage.

Sharing your personal data

Your personal data that will be collected as a part of the recruitment process, including in the context of the video assessments, may be transferred within the Shell group, including to Shell companies which may be located outside the Economic European Area (“EEA”) for the purposes related to the recruitment process. Shell ensures that these entities implement adequate levels of protection in order to safeguard your personal information and will not use your personal information for any other purposes than the ones set out in this Privacy Policy. Please note that Shell has adopted Binding Corporate Rules approved by the European Union data protection regulators as a mechanism to implement adequate levels of protection for transfers of personal data within the Shell group of companies.

Furthermore, the collected personal data will (occasionally) be transferred to selected third parties providing services to Shell, which may also be located outside of the Economic European Area (“EEA”) for the recruitment process. By way of example, Modern Hire, who will be hosting the video assessments within the EEA for Shell, is situated outside of the EEA and may need to access the personal data from the United States in order to provide support and certain Services as agreed with Shell. Modern Hire and other third parties will not use your personal information for any other purposes than what we have agreed with them. Shell ensures that Modern Hire and other third parties implement adequate levels of protection in order to safeguard your personal information.

Except as set out in this Privacy Policy, we will not disclose any personally identifiable information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers or other individuals.

Consequences of not providing your data

The personal data you have provided as part of the video assessment is an obligatory part of the recruitment process to allow us to give your application full consideration. Failure to provide us with such information may negatively affect your chances of being selected for any potential employment or placement.

Collection and use of non-personal information

Shell and Modern Hire may automatically collect non-personal information about you such as the type of internet browser, Internet Protocol address (“IP Address”) or other device address or ID. Shell and Modern Hire may also aggregate details which you have submitted through your video interview. You cannot be identified from this information, and it is only used to assist us in evaluating the recruitment process.

Keeping our records accurate

Retention

We’ll keep your personal data for a period of two years, unless a longer retention period is required by law.

Security of your personal data

We have implemented technology and policies with the objective of protecting your privacy from unauthorised access and improper use and will update these measures as new technology becomes available, as appropriate.

Changes to this policy

From time to time, we may make changes to this privacy policy. If we make any substantial changes to this privacy policy and the way in which we use your personal data, we will do our best to notify you of any significant changes. Please check our privacy policy on a regular basis.
