1.1. These terms and conditions govern how Shell Lubricants’ People Behind Power Photography Competition (the "Competition") will operate.
1.2. Shell U.K. Oil Products Limited (as agent for Shell U.K.) Limited, (Shell Centre, London, United Kingdom, SE1 7NA) (the "Promoter") is running the Competition to celebrate the hard work of power engineers around the world. This is how the Competition works:
- Entrants will submit either an individual photo or up to five photos to be considered together as a series (the "Photo(s)"). These photographs must be in digital format and of a 300 dpi resolution.
- The Photo(s) should reveal or showcase a 'hidden' perspective of a power engineer – for example an unusual location, angle, or view that explores a power engineer's environments or equipment, the output of their work along the value chain, or an exploration of the range of power engineer professions involved in their team.
2. HOW TO ENTER
2.1. Entry to the Competition will run from 00:01 on 07.05.19 to 23:59 [BST] on 13.09.19 (the "Closing Date") inclusive.
2.2. All entries to the Competition must be received by no later than 23:59 [BST] on the Closing Date. All entries received after the Closing Date are automatically disqualified.
2.3. To enter the Competition, go to www.shell.com/people-behind-power and upload your Photo(s) to the online entry form along with your name, email address, company name and job title. Then hit the ‘enter’ button. The Photo(s) and your identification data constitute your competition submission (“Submission”). We do not accept entries submitted through the mail.
2.4. There is no purchase necessary and no charge to register for use of the Competition website(s).
2.5. By submitting an entry to the Competition you are agreeing to be bound by these terms and conditions and the terms and conditions of any website(s) where the Competition is hosted.
3. ELIGIBILITY AND RESTRICTIONS
3.1. To participate in the Competition, you must be 18 years of age or older and legal resident in one of the following countries (the “Territory”). Void where prohibited or restricted by law.
3.1. The Competition is only open to power engineers. You acknowledge that you agree to participate in this Competition in a safe manner and that you shall ensure that your participation in the competition does not interfere with established work procedures and safe working practices for tasks with personal safety risks such as working at heights and confined spaces. Specifically, when taking photographs, you agree to comply with any safety standards or other rules, regulations and/or other requirements imposed at the location(s) at which you take such photographs. Failure to do so could lead to any Submission into the Competition being disqualified. You confirm that in the event that you have acquired the requisite consent from the relevant third party to take the photograph(s) at the location that you intend to do so. You must be prepared to provide a copy of the consent or release to the Sponsor upon request and failure to do so may lead to your disqualification from the Competition.
3.2. Employees of the Promoter and its affiliates and their immediate families are ineligible to participate in the Competition.
3.3. You are also not eligible if you were or are involved in any part of the administration or execution of the Competition or you are a government official.
3.4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). If a winner is found to be ineligible, the Promoter reserves the right to award the relevant prize to another entrant and to require the return of any prize already awarded.
3.5. Incomplete or illegible entries, or any entrant whose entry is not in accordance with these terms and conditions, will not be entered into the Competition. The Promoter also reserves all rights to disqualify entrants and disregard entries that are contrary to the spirit or intention of the Competition.
3.6. You may only submit one entry to the Competition.
4. WINNER SELECTION
4.1. There are two stages of judging to the Competition – only the global stage winner and global stage runner-up will receive prizes:
- The local stage – where all entries from a country in the Territory are judged amongst each other to select the best entry to serve as the Local Nominee from such country (the “Local Nominee”). One Local Nominee from each country in the Territory will continue to the global stage of the contest and be eligible to win the Global Prize or Global Runner-Up Prize. No prize will be awarded for being selected as a Local Nominee.
- The global stage – where the Local Nominees are judged against each other to select the overall Global Winner and Global Runner-Up.
4.2. At the local stage, entries will be judged by a panel of independent judges and a Local Nominee will be selected in each country in the Territory.
4.3. Each Local Nominee then continue to the global stage of the Competition where the Local Nominees’ entries will be judged by a global panel of judges to decide the overall, first-place Global Winner (“Global Winner”) and the global second-place runner-up (“Global Runner-Up”).
4.4. Entries will be judged based on the most creative photograph(s) that demonstrate an interesting or unusual perspective of the power industry. The criteria upon which the winner will be selected is as follows:
- Creativity – 50%
- Quality/composition – 50%
4.5. Each judging panel is made up of 3 independent judges, the composition of which is to be provided on request.
4.6. The decisions of the judges are final, non-appealable and binding.
5.1. The prize for the Global Winner of the Competition is $3,000 in vouchers issued by a Travel Company and which can be spent towards a holiday (“Global Prize”).
5.2. The prize for the Global Runner-Up of the Competition is an iPad (“Global Runner-Up Prize”).
5.3. Prize(s) are not negotiable or transferable and in the event of a prize not being available for any reasons for beyond the Promoter’s reasonable control, the Promoter reserves the right to replace the prize(s) with a prize(s) of equal or higher value. Winners are responsible for all federal, state, and local taxes and fees associated with prize receipt or use. Prizes are awarded “as is” with no warranty or guarantee, either express or implied, offered by Sponsor. Total Approximate Retail Value of all prizes: $700
6. NOTIFYING WINNERS AND CLAIMING THE PRIZE
6.1. The Promoter will notify each Local Nominee by e-mail on or before 18.09.19 that he or she is now being considered for the Global Prize. The Submission of each Local Nominee will be published on www.shell.com/people-behind-power. There will be no prize for being selected as the Local Nominee.
6.2. The Promoter will notify the Global Runner-Up by e-mail on or before 20.09.19. (“Announcement Date”). The Submission of the Global Runner-Up will be published on www.shell.com/people-behind-power.
6.3. The Global Runner-Up will receive the Global Runner-Up Prize.
6.4. The Promoter will also notify the overall, Global Winner by e-mail on or before the Announcement Date. The Submission of the Global Winner will also be published on www.shell.com/people-behind-power.
6.5. The Global Winner will receive the Global Prize.
6.6. The Promoter will contact the winners using the email details provided at the time of entry. If an email is returned as undeliverable, the judges will select an alternative winner. The Promoter’s email will include a time to respond by. If the email is not responded to within the period listed on the winner notification message, the judges may select an alternative winner and offer any prize to another eligible entrant. This process will continue for all winners until all prizes have been allocated. It is your responsibility to respond, as a winner.
6.7. Please allow 60 days from the Announcement Date for delivery of any applicable prize.

The winners list will be available after winner confirmation is complete.
7. PUBLICITY AND USE OF SUBMISSIONS
7.1. You agree that the Promoter may, but is not required to, use your Submission on its websites and in all and any other media, now known or later developed, for publicity, advertising, marketing or promotional purposes in connection with this Competition without any compensation or prior notice to you.
7.2. You grant the Promoter a worldwide, transferable, sub-licensable, perpetual, irrevocable (other than in relation to use of personal data) royalty-free, licence to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Submission in all media and any accompanying materials for these purposes.
7.3. Except where prohibited by applicable law, you hereby irrevocably and unconditionally waive in perpetuity any and all so-called “moral rights” or any similar right that you may have or acquire in the Submission and all its content, and to the extent that you cannot, you hereby consent to the Promoter doing or omitting to do any act that would otherwise infringe such “moral rights” or any such similar rights.
7.4. You agree to sign any necessary documentation that may be required for the Promoter and its designees to make use of the rights you granted above.
7.5. You warrant to the Promoter that you hold all intellectual property rights in the Submission and that the Promoter will not violate any third-party rights or law by using the Submission in accordance with these terms and conditions.
7.6. You confirm that in the event that your Submission includes images of third parties and/or content of third parties and/or confidential information, that you have acquired the requisite consent to use such images and information prior to the Submission being entered into the Competition. You must be prepared to provide a copy of the consent or release to the Sponsor upon request and failure to do so may lead to your disqualification from the Competition.
8.1. Your Submission, including your personal data, will be processed by the Promoter and its affiliates and suppliers in connection with the Competition and thereafter, in accordance with the Promoter’s privacy notice available at https://www.shell.com/privacy/b2c-notice.html. Suppliers involved in running and promoting the Competition include Daniel J Edelman Ltd and its affiliates (“Edelman”).
8.2. Personal data of unsuccessful applicants will be held for up to one year after the Competition has closed unless you request that we delete it earlier. Personal data of the Global Winner, Global Runner-up and Local nominees will be held for up to 5 years.
8.3. Certain data relating to entrants must be provided in order to enter this Competition. Refusal by entrants to provide such data shall mean that they cannot enter this Competition. Entrants have the right to request access to, amendment to and/or deletion of their personal data and to object to the processing of their personal data by contacting: Privacy-Office-SI@shell.com.
8.4. When submitting an entry into the competition in a manner that involves the collection of personal data of other participants, specifically in respect of photographs and text submitted, you need to ensure that you do so with the consent of such participants.
9.1. Entrants in this Competition agree that neither the Promoter, nor any of its affiliates or suppliers (including Edelman) will have any liability whatsoever for:
A. any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly, from participation in this Competition, including taking the Photo(s), or from acceptance, misuse or use of a prize; or
B. technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit the entrant's ability to participate in the Competition.
9.2. The foregoing shall apply in the event your data or your entry is not received or lost by the Promoter. Nothing in this clause shall limit the Promoter’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud. The provisions of this section shall apply to the maximum extent permitted by applicable law.
9.3. The Promoter accepts no liability for any indirect, special or consequential loss arising out of or in connection with the Competition, these terms and conditions or using a prize.
10. OTHER TERMS
10.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, exclude you from participating in the Competition.
10.2. To the extent permitted by applicable law, the Promoter reserves the right to hold void, suspend, cancel, or modify the Competition and to amend these terms and conditions without prior notice to you and without being liable to pay any compensation to you. 10.3. These terms and conditions shall be governed by English law, and the Promoter and you submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising out of or in connection with the Competition or these terms and conditions.
